Maryland Vehicular Manslaughter Fines & Sentencing
Recent court rulings are strengthening the punishments and consequences for those who commit Maryland vehicular manslaughter while under the influence of alcohol.
Those who choose to drive while under the influence of alcohol, and who take the life of another as a result, will be charged with felony vehicular manslaughter, which can carry with it a punishment of multiple years in state prison, steep fines and loss of all driving privileges.
Vehicular manslaughter is a very significant and serious crime. When someone driving a vehicle unintentionally strikes and kills another, this is an unlawful act, and the driver can be charged with vehicular manslaughter. Fines and sentencing for vehicular manslaughter cases can vary depending on multiple circumstances.
According to Maryland’s Criminal Law Code § 2-209, manslaughter by vehicle is a statutory felony that carries the following penalties:
- A maximum of 10 years in prison and/or a $5,000 fine;
- Administrative Imposition of 12 points and the possibility of revocation of driving privileges;
- Re-examination to maintain a driver’s license
Maryland Code, Transportation Article § 21-902 states that, “a person may not drive or attempt to drive any vehicle while under the influence of alcohol.” Furthermore, Maryland Criminal Law § 2-209 goes on to state that “a person may not cause the death of another as a result of the person’s driving, operating, or controlling a vehicle or vessel in a grossly negligent manner,” and that violation of will be deemed “manslaughter by vehicle or vessel.”
As such, individuals found guilty of vehicular manslaughter may face charges consisting of up to 10 years in prison, and may be required to pay fines as high as $5,000. However, those charged with vehicular homicide while driving under the influence of drugs or alcohol also face additional jail time of up to three to five years.
