DWI and DUI Charges

Maryland makes a distinction between driving while impaired (DWI) and driving under the influence (DUI). DWI charges are reserved for those driving with a BAC of 0.07 percent or below. Motorists who operate a vehicle with BAC levels of 0.08 percent or higher will face DUI charges. Penalties for DUI are substantially more severe than penalties for DWI charges.

Penalties for DUI Convictions

The severity of the charges a suspected offender may face depends upon the driving history of the defendant, the circumstances of the arrest and the blood alcohol concentration.

First-time DWI offender could face:

  • Up to two months in jail
  • Up to six months in jail if a minor was in the vehicle
  • A six-month minimum license suspension
  • A fine of up to $500
  • A fine of up to $1,000 if a minor was in the vehicle
  • Installation of ignition interlock device for 6 months if a minor was in the vehicle

First-time DUI offenders with a BAC of .08 to .14 with no breath test refusal could face:

  • Up to one year in jail
  • Up to two years in jail if a minor was in the vehicle
  • A six-month minimum license suspension
  • A fine of up to $1,000
  • A fine of up to $2,000 if a minor was in the vehicle
  • Installation of ignition interlock device for 6 months

Penalties for Repeat Offenders

Multiple offenses or a BAC of .15 or above lead to even harsher penalties. For example, a second DUI conviction in Maryland (BAC .08 – .14) could result in up to two years in jail, installation of an ignition interlock device for 1 year, a 6 month license suspension and a fine of up to $2,000.  A BAC of .15 or above will result in a 270 day license suspension.  A third DUI offense could result in three years in jail, a 6 month suspension,  a fine of up to $3,000 and installation of an ignition interlock device for 3 years.  A BAC of .15 or above will result in a license suspension of 270 days.  Refusal to take the breath test may result in a 2 year license suspension for a second or subsequent offense.

Additional Charges

Fines, jail time and license suspensions are not the only forms of punishment. Convicted DUI offenders also may face social and professional issues if they have a DUI conviction on their record. A DUI conviction may affect a person’s chance to get or keep a job, obtain college admission or even drive a vehicle. The costs of a drunk driving charge are also extremely high, not to mention substantial increases in insurance premiums.
